Colorado Amends Equal Pay Transparency Posting Requirements, Extends Recovery for Wage Discrimination Claims to Six Years

On June 5, 2023, Governor Polis Signed SB 23-105 into law, which will significantly change employers’ job posting and promotional notice obligations in Colorado. The law amends Colorado’s pay transparency statute, which has been in effect since 2021, to require employers to notify the colleagues of each new hire or promotion of the identity of the candidate and how to demonstrate interest in similar job opportunities in the future. Learn More

Colorado Expands Reasons Employees Can Use Paid Sick Leave

On June 2, 2023, Governor Jared Polis signed into law Senate Bill 23-017, which expands the reasons employees can use paid sick leave under Colorado’s Healthy Families & Workplaces Act (HFWA). In addition to the health and safety-related reasons employees can take sick leave under the prior iteration of the HFWA, employees may now access paid leave for qualifying bereavement and natural disaster-related reasons. Learn More

CMS Withdraws COVID-19 Vaccine Mandate

In conjunction with the Biden administration’s declaration that the COVID-19 national public health emergency ended effective May 11, 2023, the Centers for Medicare and Medicaid Services (CMS) announced it would “soon end” its mandatory vaccination requirement and that additional guidance would be forthcoming. As anticipated, on June 5, the CMS published a final rule providing guidance to healthcare employees about unwinding provisions of its interim final rule, which mandated COVID-19 testing, education, and vaccinations. The final rule will take effect on August 4, 2023, and address three specific COVID-19 mandates. Learn More

OFCCP Identifies 250 Federal and Federally Assisted Construction Contractors for Compliance Reviews

On June 5, 2023, the Office of Federal Contract Compliance Programs (OFCCP) published its FY 2023 Construction Corporate Scheduling Announcement List (CSAL). The CSAL includes 250 employers that OFCCP has identified as federal or federally assisted construction contractors. The CSAL is a courtesy notification. If a construction contractor is on the list, the compliance review will start once the contractor receives OFCCP’s Office of Management and Budget (OMB) approved scheduling letter. OFCCP has curtailed the granting of extensions in connection with audits. Accordingly, contractors should keep an eye on their mail (regular and email) and be prepared to submit full responses to an audit request within 30 days of receiving the scheduling letter. Learn More

Nevada Ends Public Accommodations COVID-19 Paid Leave

The requirement for covered public accommodations facilities in Nevada’s Clark and Washoe Counties to provide paid time off for employees experiencing COVID-19 symptoms or who have been exposed to COVID-19 expired May 17, 2023. The requirement ended when Governor Joe Lombardo signed Senate Bill No. 441 (SB 441), which repealed several COVID-era policies. Learn More
