Colorado Enacts Legislation Restricting Employers from Requesting Age-Related Information from Job Applicants
On June 2, 2023, Colorado Governor Jared Polis signed into law Senate Bill 23-058, the Job Application Fairness Act (JAFA), prohibiting employers from inquiring about a job applicant’s age during the hiring process. JAFA’s enactment adds to the requirements and proscriptions Colorado has implemented in the hiring process, including a “ban-the-box” restriction on inquiring about criminal histories and requiring the inclusion of salary and benefits information in job postings. Federal Court Holds That Employees Cannot File Private Lawsuits Against Their Employers Under New Jersey Cannabis Law
In a case of first impression, the U.S. District Court for the District of New Jersey found the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (“the Act”) does not create a private right of action for individuals who believe their rights have been violated under the Act. New York State Legislature Seeks to Expand Employee Rights to Freelancers Statewide
Earlier this month, both chambers of New York’s legislature approved bills that would provide employment-based protections to freelance workers, including the ability to file claims with the State Department of Labor. New York City enacted a similar law in 2017 that is enforced by the City Department of Consumer and Worker Protection. New York City enacted its version of the Freelance Isn’t Free Act in 2016, which took effect in May 2017. Learn More
New York Legislature to Increase Executive, Administrative, and Professional Compensation Threshold, Expanding Certain Wage Payment Protections
New York’s threshold for a white-collar worker exemption is slated to be increased under legislation passed by the New York legislature last week. This requirement does not directly relate to New York’s salary threshold for white-collar exemptions under the New York Wage Orders, the pending increases to which we discussed earlier this year, but rather to a different threshold for the applicability of several wage-related requirements under New York law. Montana Enacts a Name, Image, and Likeness Law for Student-Athletes
Montana Senate Bill 248 went into effect on June 1, 2023. This law allows student-athletes to earn compensation from Name, Image, and Likeness (NIL) endorsement deals and is part of a trend of NIL legislation being passed by states that allow student-athletes to monetize endorsement deals.
