We have a hand full of employees that have FSA accounts; with that being said we fund them up front at the beginning of the year. My question is what happens when an employee terminates before all the deductions are taken from them. I know we can’t make them pay the remaining balance but does that portion (balance remaining) now become a taxable benefit to the employee and need to be reported on the W2 somewhere? I have a salaried employee who is out sick out of her leave time. We offer STD and can help her file for this but do we have to pay her the full week if she has exhausted her PTO? Second question, can we make a policy that salaried employees can only miss X amount of time from work for sick days? We are afraid that we have an employee that calls out sick often and is paid for these days since she is salary exempt but abusing this. Thank you Read More I have a salaried employee who is out sick out of her leave time. We offer STD and can help her file for this but do we have to pay her the full week if she has exhausted her PTO? We have an employee who was recently terminated. He reported to our home office in Montgomery County, Maryland but worked a territory outside of the county. Montgomery County has a specific sick leave accrual policy. Regardless of his territory, we would still have to pay the terminated employee for the sick leave he accrued? We are a church and each year our Board of Directors decides on a percentage for across the board raises. We have a newer employee who wants to refuse this raise so she doesn’t lose government benefits. Can we allow this, and if so, how do we document it so she can’t come back later and claim discrimination? We have an employee who has state benefits that require her to stay below a certain income. She was hired to work a certain amount of hours and now cannot do that without going over. She stated that once she reaches the dollar amount she is allowed to earn, she would like to continue to work without compensation. She stated that since we are a church she would “volunteer”.(Her mother is a CPA and advised her that this is okay) Her position is a job sharing one and has always been compensated.
