In this situation, do more listening than talking. Make good notes. Let him explain the objection to the vaccine. Don’t debate or defend. Just take a kind and concerned position of assistance.
The law says religious or ADA issues are the only two reasons for exemption. If the objection is personal or philosophical, there is no legal provision. But, you must listen and hear him out. If the issues are ADA or religion, go through the interactive process and review all available accommodations. There may be few or even none. But, you are duty-bound to review and consider. Ask the employee for his suggestions.
Don’t make a hasty decision even if you are certain there are no options. Don’t give him hope but take a day to write up your full review of the request and then come back with your decision. It may be that he is left with the decision to vax or resign. Have a resignation letter prepared for him to sign at the second meeting. If he refuses to sign, then he will be terminated if that is your only other option.
