Illinois Becomes the First State to Enact Protections for Freelance Workers

On August 4, 2023, Governor JB Pritzker signed the Freelance Worker Protection Act (FWPA) (HB1122) into law, establishing strict protections for freelance workers. The FWPA defines a “freelance worker” as anyone hired or retained as an independent contractor to provide products or services in Illinois or for any Illinois-based entity in exchange for compensation of at least $500 (either in a single contract or in the aggregate of all contracts during the last 120 days). Learn More


NLRB Adopts Tough New Standard for Workplace Rules

On August 2, 2023, in Stericycle, Inc., 372 NLRB No. 113 (2023), the National Labor Relations Board adopted a strict new legal standard for evaluating the validity of workplace rules under the National Labor Relations Act. In Stericycle, the Board majority overruled The Boeing Co., 365 NLRB 154 (2017), its prior standard under which rules, policies and handbook provisions were treated either as categorically lawful or as subject to a balancing test that weighed their tendency to restrict employee rights against the business needs justifying them. Learn More


New Edgewater, Colorado Minimum Wage Ordinance Highlights Compliance Challenge

The Colorado locality of Edgewater—which borders Denver and has a population of around 5,000—has enacted its own local minimum wage ordinance, which takes effect January 1, 2024. The new law demonstrates how challenging multi-jurisdiction compliance can be for employers. Since 2020, Colorado law has allowed local governments to enact their own minimum wages, but to date, Edgewater is only the second jurisdiction to do so after Denver. Learn More


Illinois Extends Bereavement Leave Rights for Illinois Employees

Illinois recently expanded bereavement leave rights for two groups of Illinois employees: (1) parents who lose a child to suicide or homicide, and (2) family members of those killed in a crime of violence. Learn More
