Effective November 1, 2023
In Massachusetts, there’s an important update to the Paid Family and Medical Leave (PFML) regulations that expands the benefits for employees. As of recent amendments, workers are now permitted to complement their PFML benefits with any accrued paid leave from their employer’s offerings. This can include sick days, vacation time, or personal leave. However, it’s important to note that the sum of PFML benefits combined with the accrued paid time cannot surpass the individual’s regular weekly earnings. This provision is set to take effect for all PFML benefit claims submitted from November 1, 2023, onwards.
Before these amendments, the state’s PFML benefits could only be augmented using employer-sponsored disability, or paid family or medical leave benefits, not any other type of paid leave. The only exception to this was during the initial waiting period, which is unpaid, during which employees were allowed to use any type of paid leave provided by their employer.
The Department of Family and Medical Leave (DFML) advises employers to communicate this significant update to their staff promptly. Employers will also carry the responsibility of ensuring that the combined total of PFML and other paid leave in a given week does not exceed the employee’s standard weekly wage.
