As an employer, it can be challenging to stay on top of the latest changes in state employment laws. With new regulations continuously being enacted, it’s essential to keep up and ensure that your policies and practices are compliant.
Here are some of the changes to look out for in the coming months and years:
May 2023
California’s Pay Transparency for Pay Equity Act will undergo amendments effective in May. New Jersey’s Temporary Workers’ Bill of Rights will have some provisions effective on May 7, with the remaining requirements effective August 5.
June 2023
New York will expand its law governing break time for nursing employees effective June 7. The Federal Pregnant Workers Fairness Act requirements will take effect on June 27. Michigan will amend its Civil Rights Act to add sexual orientation and gender identity or expression as classes protected from discrimination, effective June 14.
July 2023
Bloomington, Minnesota will implement paid sick leave requirements effective July 1. The D.C. Cannabis Employment Protections Amendment Act will take effect on July 1. Maryland will legalize recreational marijuana through a constitutional amendment effective on the same day. Virginia will require employers with 50 or more employees to provide unpaid leave for organ and bone marrow donation effective July 1.
August 2023
Minnesota will amend the definition of race under the state’s Human Rights Act to include traits associated with race, such as hair texture and hair styles, effective August 1.
September 2023
New York’s statewide pay disclosure law will go into effect on September 17. Oregon’s paid family leave benefits will begin on September 3.
October 2023
Maryland’s paid family and medical leave contributions will begin on October 1.
December 2023 – March 2024
Colorado will require employers to provide EITC notification before December 31, 2023.
California will prohibit discrimination against off-duty use of cannabis and implement new marijuana drug screening requirements effective January 1, 2024.
Colorado’s paid family leave benefits will begin on January 1, 2024.
The Illinois Paid Leave For All Workers Act will take effect on January 1, 2024.
Employers in Illinois with more than 100 employees must file an equal pay registration certificate effective March 23, 2024.
Maryland will increase the state minimum wage to $15 an hour for all employees effective January 1, 2024.
2025
Maryland’s paid family and medical leave benefits will begin on January 1, 2025. Delaware’s paid family and medical leave law contributions are expected to begin on the same day.
2026
Delaware’s paid family and medical leave benefits will begin on January 1, 2026.
Employers should keep an eye on the California legislature, as they are considering expanding the state’s paid leave requirements to seven days of paid leave.
