In a significant move toward workplace transparency, New Jersey has joined the growing list of states requiring salary disclosure in job postings. Governor Phil Murphy’s signing of Senate Bill 2310 marks a new era for job seekers and employers in the Garden State, with the law set to take effect in June 2025.
Who Must Comply?
The law applies to:
- Private businesses with 10+ employees over 20 calendar weeks in New Jersey
- Public sector employers
- Job placement and referral agencies
- Employment agencies
Key Requirements
Promotion Transparency
Employers must make reasonable efforts to announce promotion opportunities to all current employees in affected departments. This applies to both internal and external advertisements, including internet postings and printed materials. However, promotions based solely on experience or performance are exempt from these notification requirements.
Salary and Benefits Disclosure
When posting any job or transfer opportunity, employers must include:
- Hourly wage or salary (or range)
- General description of benefits
- Overview of other compensation programs
Note: Employers retain the flexibility to offer higher compensation than initially advertised.
Special Considerations for Temp Agencies
Temporary staffing agencies have some flexibility – they’re not required to include salary information when advertising potential future positions (as opposed to existing openings).
Enforcement and Penalties
- First violation: $300 fine
- Subsequent violations: $600 fine
- No private right of action is included in the law
Looking Ahead
With implementation set for June 2025, New Jersey employers have time to prepare their hiring practices and job posting procedures to ensure compliance with these new transparency requirements.
