In a recent legal development, former employees of ByteDance, Inc., operating as TikTok, have filed a collective action lawsuit alleging violations of the Fair Labor Standards Act (FLSA). The plaintiffs, Selena Connell and Jeffrey “Beau” Wengert, claim that TikTok failed to pay overtime compensation to Inside Sales Representatives, including roles such as Business Development Managers and Client Solutions Managers.
- Misclassification of Employees: The plaintiffs assert that TikTok misclassified Inside Sales Representatives as exempt from overtime pay, despite their duties not meeting the criteria for such exemption under the FLSA.
- Unpaid Overtime: It is alleged that these employees regularly worked over 40 hours per week without receiving the legally mandated overtime compensation.
- Violation of FLSA Provisions: The complaint contends that TikTok’s practices contravene federal labor laws designed to protect employees from wage theft and ensure fair compensation.
This lawsuit underscores the critical importance of accurate employee classification and adherence to wage and hour laws. Employers should:
